Terms of Service and Public Offer

These Terms of Service govern your access to and use of the Elzo Forms website, account area, checkout, downloads, license services, support channels when available, documentation, and paid products. These Terms of Service constitute a public offer by FOP Artem Palonyi for the purchase of Elzo Forms digital products, software license services, downloads, updates, and related commercial services through elzoforms.com.

You accept this public offer by selecting a plan, expressly agreeing to the linked terms at checkout, and completing payment. Paid access is provided after successful server-side payment confirmation as described in our Payment and Delivery terms.

Accounts

You are responsible for keeping your account credentials secure and for all activity under your account. You agree to provide accurate information during registration, checkout, payment, license activation, and support requests, and to update it when it changes.

We may suspend, restrict, or terminate account access if we believe that an account is being used fraudulently, abusively, unlawfully, or in a way that harms Elzo Forms, our infrastructure, other customers, payment providers, or third parties.

Products and licenses

Elzo Forms provides WordPress plugin products, downloads, license keys, product updates, documentation, and license services according to the plan shown at checkout. A purchase grants you access to the product and related commercial license services according to the applicable license terms, activation limits, update period, and plan conditions.

Paid Elzo Forms products, license keys, activations, updates, downloads, renewals, and related commercial license services are also governed by our License Terms.

Software code may be provided under the license stated in the plugin files. A commercial purchase does not remove open-source rights that apply to code already lawfully provided to you under an applicable open-source license.

Self-service product and support model

Elzo Forms is sold as a self-service WordPress plugin. We work to make the product useful, stable, understandable, and well documented, but we do not sell private one-on-one technical support, custom setup, site-specific debugging, third-party conflict resolution, hosting administration, consulting, or custom development as part of the license price.

Help may be provided through documentation, a knowledge base, public community channels when available, and public bug reports. We may review reproducible product defects, but we do not promise response times for technical questions unless expressly stated in writing.

Billing, account access, license, payment, and refund issues may be handled privately because they may involve account or payment information.

Payments and taxes

Annual plans are paid for one year at a time. Renewal is manual. We do not automatically renew your license or charge your payment method again. Any renewal requires a separate purchase at the price shown before payment.

Prices, currency, included features, license limits, renewal conditions, and taxes are shown at checkout or on the pricing page. Payments may be processed by WayForPay or another payment provider shown during checkout. The payment provider may apply its own payer terms, limits, fraud checks, bank rules, compliance checks, and technical availability rules.

An order is considered accepted only after successful server-side payment confirmation and internal fraud or compliance checks, if applicable. A browser redirect, return page, email notification, pending payment status, or bank authorization does not by itself confirm payment or create a license.

We may refuse, cancel, review, or refund an order if we believe it is fraudulent, abusive, unlawful, made in error, affected by a technical issue, connected to prohibited use, or otherwise creates risk for Elzo Forms, other customers, payment providers, or third parties.

Payment provider role

The payment provider processes the payment and may provide payment-related services, but it is not the seller of Elzo Forms products and is not responsible for product delivery, product quality, license terms, support, compatibility, or refund decisions, except where the provider's own terms or applicable law require otherwise.

Acceptable use

You must not misuse the website, account area, license API, downloads, checkout, payment flow, documentation, support channels, or any Elzo Forms service. This includes attempting unauthorized access, bypassing license limits, sharing private license keys publicly, reselling access without permission, distributing malware, abusing downloads, scraping excessively, submitting fraudulent payments, creating abusive accounts, or using the service in a way that disrupts our systems or other users.

We may refuse, suspend, restrict, or terminate access to the website, account area, downloads, license services, support channels, and future purchases if we believe, in our reasonable and good-faith judgment, that an account, customer, domain, website, purchase, or related activity is illegal, abusive, harmful, deceptive, exploitative, malicious, or seriously unethical.

Examples may include, without limitation: malware, phishing, credential theft, spam operations, deceptive lead generation, scam websites, fraudulent financial schemes, illegal marketplaces, exploitation of minors, sexual exploitation, human trafficking, terrorist or extremist activity, hate or harassment campaigns, doxxing, unlawful surveillance, distribution of stolen data, or other activity that we believe may harm people, violate the law, or seriously conflict with the values under which Elzo Forms is offered.

Refusal of service

Elzo Forms is built and maintained by an independent developer. We want the product and related commercial services to help honest people build useful websites, not to power harmful, deceptive, exploitative, malicious, or abusive projects.

For that reason, we reserve the right to refuse, suspend, restrict, revoke, or terminate access to commercial services, including purchases, renewals, account access, downloads, license activation, license validation, updates, and support, where we believe in good faith that providing such services would support unacceptable use or create legal, ethical, security, operational, or reputational risk.

Refunds

Refund requests are handled under our Refund Policy, including our 30 days money-back guarantee where applicable.

We may, at our discretion, provide a full or partial refund, deny a refund, allow domain replacement, or refuse future service where a refund request is connected to fraud, abuse, prohibited use, chargebacks, repeated misuse, harmful activity, or violation of these Terms or the License Terms.

A refund does not create any obligation for us to provide future service, accept future purchases, restore account access, reactivate a license key, or unblock a domain.

Third-party services

The website, checkout, license system, email delivery, analytics, hosting, documentation, and WordPress ecosystem integrations may rely on third-party services such as payment processors, hosting providers, email providers, analytics tools, license infrastructure, and WordPress-related services. Those services may have their own terms, privacy policies, availability limits, compliance rules, and technical restrictions.

We are not responsible for outages, delays, errors, limitations, policy changes, or actions of third-party services that are outside our reasonable control.

Disclaimers

We work to keep the website, products, updates, documentation, downloads, and license services useful, available, secure, and reliable, but we do not guarantee uninterrupted availability, error-free operation, compatibility with every WordPress setup, response times for technical questions, or suitability for every specific purpose unless expressly stated in writing.

You are responsible for testing Elzo Forms on your own website, keeping backups, maintaining your WordPress installation, using compatible software versions, and making sure that your use of the product complies with applicable laws and regulations.

Limitation of liability

To the maximum extent permitted by law, Elzo Forms and FOP Artem Palonyi will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunities, customers, website traffic, search ranking, or reputation arising from your use of the website, products, updates, downloads, license services, documentation, or support channels.

To the maximum extent permitted by law, our total liability for any claim related to the website, products, downloads, license services, or these Terms will not exceed the amount you paid to Elzo Forms for the specific product or service giving rise to the claim during the twelve months before the claim arose.

Changes to products and services

We may change, improve, replace, limit, suspend, or discontinue parts of the website, products, downloads, license services, documentation, support channels, pricing, plans, or features over time. We will try to make reasonable product decisions, but we do not guarantee that every feature, integration, update channel, license method, or support channel will remain available forever.

Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "Last updated" date. Continued use of the website, account area, downloads, license services, or paid products after the updated Terms are posted means you accept the updated Terms.

Governing law

These Terms are governed by Ukrainian law, unless mandatory consumer protection laws in your country require otherwise.
